TERMS & CONDITIONS

These Terms & Conditions (“Terms,” “Agreement”) govern all travel arrangements and related services provided by Tiki Buffalo Travel Company, a Florida-based travel agency (“Tiki Buffalo,” “Company,” “we,” “us,” or “our”). By booking travel services through the Company, you (“Traveler,” “Client,” “you,” or “your”) agree to be legally bound by these Terms.
If you do not agree with any part of these Terms, do not book with Tiki Buffalo Travel Company.
1. GENERAL INFORMATION
1.1 Business Location.
Tiki Buffalo Travel Company operates in the State of Florida and complies with all applicable federal, state, and local regulations, including but not limited to the Florida Seller of Travel Act (Fla. Stat. § 559.926–559.939) and all relevant consumer protection laws.
1.2 Role as Travel Agent.
The Company functions solely as an intermediary between Travelers and third-party travel suppliers such as airlines, cruise lines, hotels, tour operators, and transportation providers (“Suppliers”).
1.3 Independent Suppliers.
Suppliers are independent entities and are responsible for their own services. By booking with us, you also agree to comply with Supplier-specific terms and conditions.
2. RESERVATIONS & PAYMENT
2.1 Booking Requirements.
A reservation is confirmed only after required deposits or full payments have been received and processed.
2.2 Pricing.
Prices are subject to change until paid in full. Supplier pricing may fluctuate based on availability, currency exchange, government fees, or other factors.
2.3 Payment Methods.
Accepted forms of payment include major credit/debit cards, ACH transfers, and other methods disclosed at booking.
2.4 Final Payment.
Final payment deadlines are set by the Supplier. Failure to meet deadlines may result in cancellation, forfeiture of payments, or additional fees.
3. CANCELLATIONS, CHANGES & REFUNDS
3.1 Client Cancellations.
Cancellations must be submitted in writing. Fees vary depending on Supplier policies and may include non-refundable deposits or penalties.
3.2 Client Changes.
Changes to itineraries, travel dates, names, or accommodations may result in additional fees or may not be permitted.
3.3 Supplier Cancellations.
Tiki Buffalo is not responsible for Supplier cancellations or alterations; however, we will assist with securing refunds, credits, or alternate arrangements when possible.
3.4 Refunds.
Refunds are subject to Supplier timelines and policies. Tiki Buffalo may apply administrative fees where permitted by law.
4. TRAVEL DOCUMENTS
4.1 Traveler Responsibility.
You are solely responsible for obtaining and maintaining valid passports, visas, driver’s licenses, health certifications, vaccination records, and any other travel documents required for your destination.
4.2 Entry Requirements.
Entry requirements may change without notice. Travelers are responsible for verifying current requirements with official governmental sources.
4.3 Denied Entry.
Tiki Buffalo Travel Company is not responsible if a traveler is denied boarding, entry, or exit due to incomplete or invalid documentation.
5. TRAVEL INSURANCE
5.1 Recommendation.
We strongly recommend purchasing comprehensive travel insurance, including coverage for cancellation, medical emergencies, and baggage loss.
5.2 Insurance Not Included.
Unless explicitly stated, travel insurance is not included in your booking.
5.3 Claims.
All claims must be filed directly with the insurance provider. Tiki Buffalo does not determine claim outcomes.
6. HEALTH, SAFETY & FITNESS TO TRAVEL
6.1 Fitness.
You are responsible for ensuring that you are medically and physically able to travel.
6.2 Health Requirements.
Suppliers or destinations may require vaccinations, testing, or other documentation. You must comply with all health and safety protocols.
6.3 Assumption of Risk.
Travel involves inherent risks, including illness, injury, delays, or unforeseen events. By booking, you voluntarily assume all risks associated with travel.
7. LIMITATION OF LIABILITY
7.1 No Liability for Supplier Acts.
Tiki Buffalo is not responsible for negligent or intentional acts, errors, or omissions of Suppliers, including but not limited to:
Flight delays or cancellations
Hotel overbookings
Cruise itinerary changes
Transportation incidents
Loss or damage to personal property
7.2 Force Majeure.
We are not liable for events beyond our control, including natural disasters, pandemics, political unrest, weather events, strikes, or government restrictions.
7.3 Maximum Liability.
To the fullest extent permitted by law, the Company’s total liability shall not exceed the amount paid by the Traveler for services booked through Tiki Buffalo.
8. TRAVELER RESPONSIBILITIES
8.1 Accuracy of Information.
Travelers must provide accurate personal information for all individuals included in a booking.
8.2 Compliance.
Travelers must comply with all laws and regulations of destinations, as well as Supplier policies.
8.3 Behavior.
Tiki Buffalo reserves the right to refuse service or terminate travel arrangements for any Traveler whose conduct is unlawful, dangerous, or disruptive.
9. SPECIAL NEEDS & ACCESSIBILITY
9.1 Requests.
Travelers requiring special accommodations must notify the Company at the time of booking. We will make reasonable efforts to assist in accordance with federal and Florida accessibility laws.
9.2 Limitations.
Some destinations and Suppliers may not be fully accessible. Travelers are responsible for confirming accessibility needs prior to booking.
10. PRIVACY & DATA PROTECTION
10.1 Use of Data.
Personal data is collected for reservation processing, payment handling, and communication.
10.2 Compliance.
Tiki Buffalo complies with applicable federal and Florida privacy laws.
10.3 Third-Party Sharing.
Information may be shared with Suppliers as necessary for booking completion.
11. DISPUTE RESOLUTION
11.1 Governing Law.
These Terms are governed by the laws of the State of Florida and applicable federal law.
11.2 Venue.
All disputes shall be resolved exclusively in the state or federal courts of Florida.
11.3 Mediation/Arbitration.
Before litigation, both parties agree to attempt resolution through good-faith mediation. Arbitration may be used if mutually agreed.
12. AMENDMENTS
12.1 Official Amendments Only.
Tiki Buffalo may update or modify these Terms at any time. The most current version will be provided upon request and/or published by the Company.
12.2 Future Bookings.
Amendments apply to future bookings unless legally required otherwise.
13. NO UNAUTHORIZED MODIFICATIONS
13.1 Employees May Not Modify Terms.
These Terms & Conditions cannot be changed, waived, or modified by any employee, agent, or representative of Tiki Buffalo Travel Company.
Any verbal or informal statements attempting to alter these Terms are invalid and unenforceable.
13.2 Official Written Changes Only.
Only written amendments issued by the Company’s authorized executives or legal representatives are valid.
14. ACCEPTANCE OF TERMS
14.1 Booking Indicates Consent.
By booking or participating in travel services arranged by Tiki Buffalo Travel Company, you acknowledge that you have read, understood, and agree to all Terms & Conditions herein.
14.2 If You Do Not Agree.
If you do not agree to these Terms, do not book travel services through Tiki Buffalo Travel Company.
